On February 23, 2019, around 2 a.m., a fatigued driver operating a commercial tractor-trailer westbound on I-10 missed his exit. He exited 653 US Highway 90 and used a Shell gas station driveway as a turn around. At approximately 2:05 a.m. in the dark of night, he backed out the tractor-trailer from the Shell gas station perpendicular across US Highway 90 – blocking moving lanes of traffic. At the same time, our client was driving a 2018 Mitsubishi Mirage southbound on US Highway 90 towards the peak of a crest in that section at the highway. His car crashed into the side of the tractor-trailer at highway speed, bringing his car to a dead stop. Unfortunately, the driver of the 18-wheeler failed to stop and render aid, leaving our client for dead.
Our firm was honored to get the call on this important case. Attorney Garrett Wilson mobilized our team quickly, attending to the family’s needs while Attorney Alex Boylhart immediately filed and received a temporary restraining order that proved essential in getting our expert access to the tractor trailer. From there our investigation team gathered evidence that shows our client never saw the tractor-trailer blocking US Highway 90 that tragic night. Says Kwok, “Our young man never had a chance to avoid the big rig illegally parked on the highway. Our thoughts and prayers are with him and his family.”
