Refinery/Plant Explosions

Rob Kwok founder of Kwok Daniel Ltd, LLP is familiar with big oil British Petroleum, having filed the first wrongful death case arising from the tragic BP explosion on March 23, 2005 which killed over 15 workers. Mr. Kwok successfully resolved the wrongful death case and a group of injury cases, but when BP refused to pay the last lawsuit, Mr. Kwok brought the case to a Galveston County jury. After conducting jury selection of over 200 Galveston County residents, a jury was seated. The case settled that same evening for a confidential sum with lifetime payments to the decedent’s children.

Says Mr. Kwok, “BP is a giant in the petro-chemical industry, and BP’s giant profits come with giant responsibilities. When workers lose their lives in an explosion, there’s always something that could be done better to prevent the tragedy.”

In 2012, Mr. Kwok filed a wrongful death lawsuit against Oiltanking Holdings, a crude oil storage terminal in Jacintoport, Houston, arising from an explosion that violently killed one worker and severely injured several other workers. Litigation ensued for over a year and Mr. Kwok’s trial team tried the case in November 2013. After a 6 week jury trial, a Harris County jury returned a verdict of $20.2 million in actual damages. It was the largest jury award of it’s kind in Harris County for 2013, and the verdict was recently honored by the Texas Lawyer with inclusion into the Texas Verdicts Hall of Fame, a lifetime achievement for the Firm. Says Kwok, “I’m grateful for clients who trust us to do our jobs well. They know we will spare no expense in litigating with the biggest corporations on earth, and our opponents know we are fearless in our quest to help our clients.”
