Now Taking 3M Cases

Kwok Daniel Ltd, LLP is gathering a group of 3M claims to file for our deserving military clients. You may already know the 3M combat earplugs are defective. Military personnel wearing them have suffered permanent hearing loss and/or ringing in the ears. If you or a loved one served in the military from 2003 - 2015, and used these earplugs in combat, or here in the United States – ask do you have hearing issues today. If the answer is "yes", you may have a claim against 3M.

Do I have to sue the US Government?

No. This is not a case against the Government. This is a case against 3M, a multi-billion-dollar corporation which has made millions of dollars from government contracts for our US military personnel.

What about my VA rating?

In most cases, your VA rating and benefits should not be affected. Treatment and testing for your 3M claim will not go through the VA. But we will need to review your VA disability rating and benefits on a case by case basis. In some instances, the US Government may be entitled to reimbursement for benefits paid, depending on your disability rating.

Is this a class action lawsuit?

No. This is a mass tort lawsuit against 3M. Tens of thousands of military personnel have been damaged by using defective earplugs. That means you have your own individual case with your own damages.

Is this a clear liability case against 3M?

Yes. The US Government sued 3M under false claims act for lying about the effectiveness of the combat earplugs. Rather than defending against the allegations, 3M settled the lawsuit for $9 million. The evidence showed 3M knew as of early 2000 that the earplugs were too short and let noises through. 3M covered up their bad plugs and profited from them anyways – at the expense of our veterans.

How much is my case worth?

Generally, total hearing loss is worth more than partial hearing loss. So far, tinnitus (ringing int he ears) is a wild card. We are unsure how a jury would value these cases. But clearly, constant ringing in your ears for the rest of your life is valuable. We will fight for six and seven figures for the vast majority of our cases. Much of this will depend on the Court's rulings and verdicts from "bellwether" trials.
